1. Agreement to Terms
This document constitutes an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable. This electronic record is generated by a computer system and does not require any physical or digital signatures.
By visiting our website mahasell.in (“Site”) and/or purchasing from SP.GOOSEBERRY TEXTILE PRIVATE LIMITED (“we”, “us”, or “our”), you engage in our “Service” and agree to be bound by the following Terms & Conditions (“Terms”), including our Privacy Policy and Refund Policy.
2. User Eligibility & Account Obligations
By agreeing to these Terms, you represent that you are at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872.
- You are responsible for maintaining the confidentiality of your account credentials and mobile login details.
- You agree to provide true, accurate, current, and complete shipping address and recipient mobile information during checkout.
- Maha Sell reserves the right to terminate accounts, cancel unverified orders, or refuse service at its sole discretion if false details are identified.
3. Product Authenticity & Quality Standards
Quality & Color Specifications:
Every product showcased at Maha Sell undergoes multi-point quality inspections. For apparel and footwear items:
- Natural fabric textures, weave characteristics, and subtle finishes are integral to genuine manufacturing standards.
- Photography colors may vary slightly depending on digital display calibration, lighting conditions, and screen brightness.
4. Pricing, Taxes & Payment Gateway Terms
All prices on the website are displayed in Indian National Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST).
• Payment Gateways: Online transactions are routed through our RBI-authorized partner, Razorpay. We accept UPI (Google Pay, PhonePe, Paytm, CRED), Net Banking across all major banks, Visa, MasterCard, RuPay, and American Express.
• Payment Authorization: By initiating a payment, you confirm that the card, bank account, or UPI ID used is rightfully yours. In case of payment gateway failures where funds are debited from your bank but order is not generated, funds are automatically reversed by your issuing bank within 3 to 5 working days.
• Cash on Delivery (COD): COD is available on select pincodes across India and may require mobile OTP verification before dispatch. High-value bulk orders may require partial prepaid booking confirmation.
• International Tariffs: International orders shipped outside India may be subject to local customs duties and VAT determined by the destination country's customs authority. These charges are the recipient's responsibility.
5. Order Acceptance & Right to Cancel
Receipt of an electronic order confirmation does not signify our final acceptance of your order. Maha Sell reserves the right at any time after receipt of your order to accept, decline, or limit order quantities for any reason, including:
- Unavailability of inventory stock or supplier batch variations.
- Inaccuracies or typographical errors in product pricing.
- Inability to obtain payment authorization or suspected fraudulent activity flagged by payment risk engines.
If an order is cancelled by us after your payment has been processed, a full 100% refund will be credited back to your original payment mode within 5 to 7 business days.
6. Shipping, Delivery & Risk of Loss
All deliveries are insured during transit against theft, loss, or damage until doorstep handover to the recipient.
- Standard Domestic Delivery timeline: 2 to 4 business days across metro cities; 3 to 6 business days for non-metro PIN codes.
- International Delivery timeline: 4 to 7 business days via DHL Express.
- Customized Tailoring: Adding bespoke blouse stitching requires an extra 3 working days prior to courier dispatch.
7. Returns, Replacements & Refunds
Our comprehensive return and cancellation terms are detailed in our dedicated Refund & Cancellation Policy. Key provisions include:
- Cancellation window: Up to 24 hours from order placement or before courier dispatch for a full 100% refund.
- Return window: 7 days from the date of physical delivery for unworn sarees with Silk Mark intact.
- Refund timeline: Processed within 5 to 7 business days back to the original payment source.
8. Intellectual Property & Brand Copyright
All content published on this website—including brand name, logos, product photography, editorial chronicles, graphic design, and software—is the exclusive intellectual property of SP.GOOSEBERRY TEXTILE PRIVATE LIMITED and is protected under Indian Copyright and Trademark laws. Unauthorized reproduction, scraping, or commercial exploitation is strictly prohibited.
9. Limitation of Liability & Disclaimers
In no event shall Maha Sell, its directors, employees, or affiliates be liable for any indirect, incidental, punitive, or consequential damages arising out of the use or inability to use our products or website. Our total aggregate liability under any contract or order shall not exceed the actual invoice amount paid by you for the specific item in question.
10. Governing Law & Jurisdiction
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any disputes, controversies, or claims arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in Kushinagar, Uttar Pradesh, India.
